Whether you are the wounded victim or the family of a deceased loved one, the following steps should be taken after a car accident:

  1. Stay Calm – Remain on the scene and ensure that everyone is okay. Check yourself for injuries before examining others. Maintain composure and do not confess guilt.
  2. Get to a safe place – Get to a secure location; if possible, move disabled vehicles to the side of the road. Place your emergency flashers to prevent additional accidents. Get to a secure location and wait for the police.
  3. Call 911 – Report the accident to the authorities. Call the police unless your collision was minor, without injuries or property damage. Authorities can document the incident, collect information, and include it in an official record.
  4. Exchange information – With the other driver(s) involved in the accident, exchange names, phone numbers, and insurance information. If feasible, photograph the vehicles, license plates, and other pertinent information.
  5. Don’t admit fault – Avoid admitting culpability, even to the authorities. When speaking with a police officer, only recount actual events. Be as specific as feasible when describing the collision.
  6. Seek medical attention – Visit the hospital or your primary care physician. Immediate medical attention can lessen the severity of injuries. Tests and examinations can detect internal injuries that may not manifest symptoms.
  7. Tell your insurance provider – Most insurance providers have time limits for when you must report an accident. Call immediately and follow the agent’s instructions to report the accident.
  8. Speak to insurance adjusters – The instant the day of your accident, you might be given a telephone call from the other party’s insurer. You may speak with the claims adjuster but only provide the necessary information. Do not record a statement or accept an insurance settlement offer before consulting a Los Angeles car accident attorney.
  9. Create a file – Maintain accident-related files in an organized fashion. Your file should include a copy of the police report, medical expenses, the other driver’s information, injury treatment programs, and any other incident-related documents you’ve collected.
